These Terms of Use ("Terms") govern your access to and use of the Site, including browsing, placing orders, creating an account, and any other interactions. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site and place orders. By using the Site, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

2. Account Registration To place orders or access certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

3. Orders and Payments

  • All orders are subject to acceptance by us. We may refuse, cancel, or limit any order (including those already confirmed) for reasons such as product unavailability, pricing errors, suspected fraud, or other issues.

  • Prices are in USD and exclude applicable taxes, delivery fees, and tips (if applicable). Prices and availability are subject to change without notice.

  • Payment is processed through secure third-party providers (e.g., Stripe or similar). We do not store full payment card details. By providing payment information, you authorize us (and our providers) to charge the total amount.

  • You are responsible for any additional charges (e.g., delivery fees, service fees from third-party delivery partners).

4. Shipping, Delivery, and Pickup

  • Delivery is available only within designated Los Angeles-area zones (check the Site for current areas).

  • We use third-party delivery services for some orders; delivery times are estimates only and not guaranteed. We are not liable for delays, failed deliveries, or issues caused by carriers.

  • For pickup orders, you must collect within the specified window; uncollected orders may be canceled without refund.

  • Gelato is a perishable product requiring refrigeration. Upon delivery or pickup, it is your responsibility to store it properly (e.g., in a freezer) immediately. We are not liable for spoilage, melting, or quality issues after handover.

5. Returns, Refunds, and Cancellations Due to the perishable nature of gelato, we generally do not accept returns or exchanges except in cases of proven quality defects (e.g., incorrect order or damaged product reported immediately upon receipt).

  • Contact us within 2 hours of delivery/pickup for issues.

  • Refunds, if approved, will be issued to the original payment method.

  • Orders cannot be canceled once preparation begins. We reserve the right to refuse refunds in cases of misuse or abuse.

6. Product Information and Disclaimers

  • Product descriptions, images, and flavor details are for informational purposes and may not capture every variation (e.g., due to handmade production).

  • Gelato may contain common allergens (milk, nuts, eggs, soy, etc.). Always check ingredient lists. We are not liable for allergic reactions or failure to review allergen information.

  • All products are sold "as is." We disclaim all warranties, express or implied, including merchantability or fitness for a particular purpose, to the fullest extent permitted by law.

7. Intellectual Property The Site, including text, photos, logos, flavor names, designs, and content, is owned by us or our licensors and protected by copyright, trademark, and other laws.
